These terms and conditions describe the basis for the purchase by you and sale by us of the goods described on www.mulberry.com (the Website) which we own and maintain.
These terms and conditions should be read alongside, and are in addition to, our Privacy Policy and our Cookie Policy which tell you how we use your personal information.
Placing an order
By placing an order on this Website, you confirm that you have read these terms and conditions and the Privacy Policy, and that you agree to them. You should keep a copy of these terms and conditions for future reference. We will not always file a copy of orders made by you.
Each order that you place is an offer to buy those goods and we shall accept that offer at our sole discretion, but orders are normally accepted if:
(a) the goods are available;
(b) the order reflects our current pricing;
(c) the goods are for delivery to a destination that we deliver to or are for collection in one of our stores; and
(d) your credit or account card is authorised for the transaction.
We will confirm receipt of your order through our automatic screen confirmation of the order and we may also follow this up with a confirmatory email. Please note that at this stage your order for goods may not have been accepted by us.
Formation of the contract
If we accept your order for goods, we will send you an email confirming that the goods have been shipped ("Shipping Confirmation").
The contract between us will only be formed when we send you the Shipping Confirmation (the "Contract"). These Terms of Sale, the Shipping Confirmation, the Returns Policy and any other information relating to the goods which we have brought to your attention are incorporated into the Contract.
The Contract will only relate to those goods which have been confirmed in the Shipping Confirmation and we will not be obliged to supply any other goods which you have ordered until we have sent you a separate Shipping Confirmation in respect of such goods.
Prices
The price of the goods and our delivery charges (where applicable) will be as set out on the Website from time to time and we are not responsible for honoring pricing errors.
All prices on the Website exclude any applicable sales taxes. These will be calculated according to the destination of where your order is being delivered to and are included in the total price displayed when you complete your order.
We reserve the right to amend our prices and delivery charges at any time, but such changes will not affect any order for which we have already sent you a Shipping Confirmation.
The Website sells a large number of goods, so it is possible that despite our commercially reasonable efforts, that some goods may be incorrectly priced. We will usually verify the price of any goods as part of our shipping process and if the price of the goods:
(a) is lower than the price stated on the Website, we will charge this lower amount to you when shipping the goods to you; or
(b) is higher than the price stated on the Website, we will at our discretion (and subject to applicable law) either contact you for instructions prior to shipping the goods or reject your order and notify you of such rejection by email.
We are under no obligation to provide goods to you at an incorrect price, even once we have sent a Shipping Confirmation to you.
Payment
We accept payment by credit card and debit card, as set out on the Website. Payment for the goods and related costs will be processed once we ship your order.
You confirm to us that you are authorised to use the payment method that you provide to us when placing your order. We may carry out security checking to confirm that this is the case.
If your payment method is not authorised, we may refuse to accept your order and we will not have any responsibility for the non-delivery of the goods.
We are also not responsible for any charges or penalties which may be imposed by the payment provider as result of payment being processed in respect of your order.

What is Installments with Afterpay?
Installments with Afterpay is a service that allows you to make purchases now and pay for them in four payments made every 2 weeks without any interest.
How do I use Installments with Afterpay?
Simply shop online and add items to your shopping bag and checkout as normal. At the checkout choose Installments with Afterpay as your payment method. First-time customers will need to register with Afterpay and provide payment details, as usual, returning customers simply log in to make their purchase. It’s that easy!
Please note that all items in your shopping bag must be eligible for Installments with Afterpay. You must meet additional eligibility requirements to qualify.
Where can I use Installments with Afterpay?
Installments with Afterpay can only be applied to purchases made on Mulberry.com.
Can I use Installments with Afterpay if I’m an international customer?
Afterpay is only offered to our customers who have a US billing address, US shipping address, a US Visa or Mastercard (credit or debit card), or American Express and a US mobile phone number. Customers with international billing addresses, shipping addresses, and/or phone numbers will not be able to set up an account with Afterpay.
How does the payment schedule work?
All customers are required to make their first payment at the time of purchase, with the remaining three payments deducted every two weeks from your chosen payment method. If you choose to make additional payments before your scheduled pay dates, you may do so through your Afterpay account.
You can log in to your Afterpay account to view your payment schedule and make a payment before the due date if you choose to do so.

Afterpay is not available on purchases of gift cards. If you are purchasing gift cards along with Afterpay eligible products, you will need to place two separate orders.
How do I return or exchange an item purchased using Installments with Afterpay?
If you have changed your mind, you can return your Afterpay purchase in-store or by mail for a refund. Please check that your return or exchange meets our Return policy here. Afterpay will be notified of your return and will process the appropriate refunds. Please do not return your purchase to Afterpay.

What if I can’t pay an Afterpay installment?

What happens if I have a partial refund, and how does that affect my payments?
Afterpay will be notified once your refund is processed. Your payment plan will be automatically adjusted to reflect the new total order value starting with the last payment and working backward. In the case where a refund amount is larger than 25% of the total order, Afterpay will eliminate the fourth installment payment and apply the remaining amount to your earlier payments.

Rückerstattungen
Wenn Sie Ihren Vertrag gekündigt oder die Waren gemäß diesen Nutzungsbedingungen zurückgesendet haben, wird Ihnen der komplette Preis, den Sie für die Waren bezahlt haben, erstattet. Im Falle einer Vertragskündigung sind in dieser Erstattung jegliche anfallenden Lieferkosten enthalten.
Wir verarbeiten die fällige Rückerstattung so schnell wie möglich und spätestens 30 Tage nach dem Datum, an dem Sie den Vertrag gekündigt oder uns darüber informiert haben, dass Sie die Waren zurücksenden möchten. Wir verwenden für die Gutschrift die Kreditkarte oder Debitkarte, die Sie bei der Bezahlung angegeben haben.
Haftung
Bei einem Vertragsbruch unsererseits haften wir nur für Verluste, die als vorhersehbare Folge eines solchen Vertragsbruchs entstehen und nur in angemessenem Rahmen. Verluste gelten dann als vorhersehbar, wenn sie bei Abschluss des Vertrags von Ihnen und uns in Erwägung gezogen werden könnten.
Wir übernehmen keine Verantwortung für:
(a) Verluste, die nicht durch einen Vertragsbruch durch uns verursacht wurden;
(b) indirekte Verluste, die als Nebeneffekt des Hauptverlustes oder -schadens entstehen und von Ihnen und uns nicht bei Vertragsabschluss vorhergesehen werden können, so zum Beispiel Profitverluste oder verpasste Chancen bzw.
(c) nicht bereitgestellte Waren oder Nichterfüllung jeglicher Verpflichtungen gemäß des Vertrags, wenn die fehlende Bereitstellung bzw. die Nichterfüllung auf Ereignissen höherer Gewalt basieren.
Unser gesamter Haftungsumfang Ihnen gegenüber in Verbindung mit jedem Vertrag darf den Wert der von Ihnen unter diesem Vertrag bestellten Waren nicht überschreiten.
Kein Bestandteil dieser Bedingungen soll unsere Haftung im Falle von Tod oder Personenschaden, der durch unsere Nachlässigkeit oder Betrug veranlasst wird, ausschließen oder einschränken. Dies gilt auch für jegliche andere Haftung, die laut Gesetz nicht ausgeschlossen oder eingeschränkt werden darf.
Im Falle eines Vertragsbruchs Ihrerseits, der keine Maßnahmen unsererseits nach sich zieht, sind wir nach wie vor berechtigt, unsere Rechte und Ansprüche bei anderen Vertragsbrüchen geltend zu machen. Wenn ein Teil des Vertrags nicht anerkannt oder von einem Gericht oder Verordnungsgeber als ungültig erklärt wird, gelten die anderen Bestimmungen weiterhin.
Wir haben die Möglichkeit, unsere Rechte und Pflichten unter einem Vertrag an eine andere Organisation zu übertragen; dies hat aber keine Auswirkungen auf Ihre Rechte und Pflichten unter dem Vertrag. Jeder Vertrag gilt für Sie persönlich und Sie können Ihre Rechte oder Pflichten unter einem Vertrag nur nach vorheriger schriftlicher Genehmigung unsererseits an eine andere Person übertragen. Ein Vertrag ist nicht dafür ausgelegt, einer anderen Person außer Ihnen und uns Rechte zu übertragen.
Wir bemühen uns, jegliche Streitigkeiten im Zusammenhang mit jeglichen Verträgen beizulegen. Wenn Sie ein Gerichtsverfahren gegen uns einleiten möchten, muss dies innerhalb des Vereinigten Königreichs stattfinden. Es gelten die Gesetze von England und Wales.
